Dr. Grigoriy Mashkevich's website is currently missing its photo gallery, where one imagines pre- and post-op images might've once appeared.

About two years ago, a 24-year-old woman went under a surgical knife for rhinoplasty ? a nose job. In early 2013, when she happened to look at her plastic surgeon's new website, she saw a blast from the past: Her old nose. A legal complaint filed by the woman's attorney alleges that the surgeon posted "before" and "after" photographs of the woman's face on his website without her consent.

"[Plastic surgeons] are very excited about putting pre- and post- op photos on their websites," Bryan Swerling, the attorney representing the plaintiff, Catherine Manzione, points out to NBC News. Doctors with different specialties ? he offers oncologists as an example ? wouldn't do such a thing.

"[Plastic surgeons] show [potential patients] photos of other patients in their offices," Swerling said. "And what happens is, right before they have surgery, [patients] are generally confronted with a form [giving permissions for their photos to be used]."

When Manizone was presented with such a form by Dr. Grigoriy Mashkevich, though, the woman specifically signed the section indicating that she did not give the doctor permission to use her pre- and post-op images, said Swerling. Nevertheless, Mashkevich used four photos ? two pre- and two post-op ? of Manzione on his website.

As a result, Manzione was "greatly distressed and humiliated ... exposed to public ridicule ... and greatly injured in her reputation," reads the complaint filed with the New York State Supreme Court.

Swerling said that, at one point, Mashkevich's staff contacted his client to apologize about the use of the photographs, claiming that they were posted due to a mistake made by a Web developer. "This is not a doctor releasing photographs, this is a doctor releasing medical records," Swerling reminds, pointing out that the Web developer had to be provided with those photographs by Mashkevich's staff in the first place.

Despite repeated calls to Mashkevich's office, NBC News has not been able to reach the doctor or his legal representation.

"Photographs may be protected health information (without any other identifying information) if they are 'full face' pictures or the equivalent," Rachel Seeger of the Health and Human Services Office for Civil Rights explained to NBC News, though she was not able to comment on this particular case.

The complaint filed by Swerling asks for $18 million in damages, but the attorney said that such an amount shouldn't be the subject of attention when it comes to this stage of the legal process. "When an attorney writes a complaint, he has to leave himself some wiggle room," he said. Some of the causes of action (and their associated damage claims) can be thrown out at some point, sometimes even leaving only one cause and a much less substantial amount.

Swerling said that he settled in a case similar to Manzione's in April. "An older woman" who'd had plastic surgery in the early '90s, when the use of pre- and post-op images on websites wasn't even addressed in the forms she signed, found her images ? just as Manzione did ? on her plastic surgeon's website later on. Swerling wasn't able to disclose what the settlement amount was, but the case dragged out for about a decade, he said.

Governor calls Texas lawmakers back to session on abortion bill

AUSTIN, Texas (Reuters) - Texas Governor Rick Perry on Wednesday called a second special session of the legislature on July 1 in a bid to overcome Democratic efforts to thwart proposed new restrictions on abortion.

A Democratic state senator spoke for 10 hours on Tuesday to block a vote in the Republican majority chamber on a proposal that would ban abortion after 20 weeks of pregnancy. The filibuster ran to the end of the first 30-day special session, which expired at midnight.

Menopause: What It Is and Ways to Manage It ? About Obesity Surgery

What is menopause? Menopause is the cessation of a woman?s monthly blood flow. If a woman has not experienced menstrual flow for 12 consecutive months, she is menopausal.

Except in the case of surgery, chemotherapy or specific medical conditions that interfere with regular hormonal functions, menopause occurs at the end of a process, which may last from months to years. During the process, periods may become irregular but not stop and a woman may intermittently experience other symptoms of menopause. When a woman is experiencing symptoms but has not yet been without periods for 12 consecutive months, she is peri-menopausal. A woman may become peri-menopausal as early as her thirties or as late as her fifties.

What are symptoms of menopause? Symptoms of menopause fall into five broad categories:

1) Changes in blood vessel dilation and constriction. This blood vessel activity causes hot ?flashes? and sleep irregularities. Hot flashes are not related to the internal temperature of the body but rather to the temperature of the skin. There are various theories about why, during menopause, women?s skin temperatures may rise periodically as much as 7 degrees. One of the most intriguing theories is that women who experience hot flashes have a very narrow comfort zone ? that zone where they are neither sweating nor chilled. Estrogen seems to widen that zone; conversely lower estrogen narrows the zone. (Studies conducted by Dr. Robert R. Freedman and colleagues, Wayne State Univ., Detroit). Hot flashes contribute to sleep irregularities.

2) Urinary/genital tract changes. Women may experience thinning, drying, itching and bleeding in the vaginal area sometimes associated with pain on intercourse. Another issue may be urinary frequency, urgency or incontinence.

3) Bone changes. Changes in the bones may result in osteopenia (pre-osteoporosis), osteoporosis, joint and muscle pain or back pain.

4) Skin and soft tissue changes. Skin may thin as part of menopause or lose elasticity and breasts may become smaller. These changes are associated with the loss in estrogen that accompanies menopause.

5) Psychological/mood changes. Changes in mood may include irritability and depression or be accompanied by fatigue and memory loss.

How can menopausal discomforts be moderated? Not all women experience menopausal discomfort at a level that it requires therapy. How women experience menopause, a natural stage in the lifecycle of a woman, is in part a matter of genetics, in part a matter of general health and nutrition and in part a matter of culture. There has been great interest lately in the fact that Asian women typically do not engage in hormone replacement therapy or consume dairy products and yet have virtually no osteoporosis as they age and progress through menopause.

1) Self-care. Ideally a self-care program begins well in advance of menopause. Preferably it is a lifelong project. It is never too late to begin, however. Self-care includes good nutrition, effective and regular exercise and mood maintenance.

Good nutrition means the appropriate balance of carbohydrate, protein and fats. Carbohydrates and fats should be of the types that promote health, that is, complex carbohydrates low on the glycemic index and mono-unsaturated and poly-unsaturated fats with the correct balance of omega 3s and omega 6s. For vitamins and minerals, eat a wide range of vegetables, fruits, nuts, grains and beans daily. Maintain the proper Ph balance in the body by limiting dairy products except for probiotics like yogurt. Eliminate simple sugars from the diet as much as possible and focus on getting adequate fiber in the diet.

Establish a daily exercise routine that includes weight bearing exercise, stretching and low-impact aerobic activity. Maintain a healthy weight. Maintain mood with proven techniques like focused breathing, meditation, a gratitude journal, meaningful activity and significant, satisfying relationships.

2) Nutritional approaches. There is a wide range of nutritional alternatives to HRT, often combined with a program of supplementation and /or herbal therapies as well as with the self-care techniques mentioned above. While some sources indicate these alternatives are not clinically proven, they have nonetheless been effective for many women.

Nutritional approaches may include plant estrogens, such as those found in soy products as well as oats, cashews, almonds, alfalfa, apples and flaxseeds. Magnesium can also help to reduce hot flashes. Magnesium is found in soy products and in whole grains and beans. Sufficient dietary fiber can help to reduce irritability. Essential fatty acids can alleviate symptoms of aging, including a reduction in skin elasticity and they can help with dryness in the vaginal region. They also act as natural hormone supplements. Multivitamin/mineral supplements should be chosen with particular attention to their magnesium content. In addition, vitamin E can have a significant impact on vaginal dryness and hot flashes. A variety of herbs have been used, among them, wild yam (for hot flashes), alfalfa, sarsaparilla, motherwort (vaginal dryness), valerian root (promotes sleep), ginseng and black cohosh. Dong quai has been used for centuries in China to provide relief for menopausal symptoms.

3) Hormone Replacement Therapy (HRT). HRT has been the most common therapy for the symptoms of menopause in the United States. It is particularly effective for hot flashes, virtually eliminating them shortly after therapy is begun. It has long been considered effective in protecting against osteoporosis because of the effect of estrogen in strengthening bone and enhancing calcification.

Following the Women?s Health Initiative Study (WHI) of the National Institutes of Health, halted in July 2002, HRT has become controversial, however. Although hormone replacement has been proved to offer many benefits, including reduced osteoporosis, there are also greater risks associated with it, including breast cancer. Patients and physicians must make the decision about HRT together, based on individual medical situations. Not only is there a decision about whether or not to use HRT but what kind of HRT: unopposed estrogen (estrogen alone), estrogen and progestin, or one or both of those hormones administered along with testosterone. Among the other things a physician will consider with his/her patient is genetic history and age. There are also differences between women with an intact uterus and women without a uterus. While breast cancer is a greater risk for the first, osteoporosis may be a greater risk for the latter. Recent reports suggest that extended use of unopposed estrogen in women who have had a hysterectomy may even reduce breast cancer, although it poses unacceptably high cancer risks to women who have not had a hysterectomy. In the latter case if used, estrogen will probably be accompanied by progestin. There has been recent interest in bioidentical hormone replacement therapies, that is, estrogen and progestin that duplicate the hormones in a woman?s body (as opposed to equine hormonal products). Studies are promising but not yet advanced enough for certainty.

Special issues. Among particular issues that may confront women in relation to the significant physical change that menopause represents are fibroids and osteoporosis. Fibroids are primarily associated with peri-menopause, that is, the time before menopause, which is marked by twelve consecutive months in which there is no menstruation. While osteopenia may begin during the peri-menopausal time, osteoporosis is associated more strongly with menopause and aging.

1) Fibroids. Fibroids are (usually benign) tumors, generally located in the uterus or uterine wall. They may range in size from less than an inch to larger than a grapefruit. Size is often explained by relating it to pregnancy, i.e., eight weeks or twelve weeks. No one is certain exactly what causes fibroids, although generally they shrink after menopause, so estrogen levels may be a factor.

Women are most likely to have fibroids if they are of childbearing age, are African-American, are obese and / or have not had children. Fibroids have been linked to an under active thyroid, so thyroid testing, treatment and monitoring should certainly be part of a preventive reproductive health program. Most women do not experience symptoms. If there are symptoms, they are most likely to include heavy bleeding or painful periods, bleeding between periods, frequent urination, pain during sex, lower back pain, reproductive problems, or a feeling of fullness or swelling in the lower abdomen. Treatments include drugs (pain relievers or medications to reduce the size of the fibroids), surgery (myomectomy, hysterectomy, endometrial ablation, myolisis); and uterine fibroid embolization (UFE). Myomectomy removes the fibroid but leaves the healthy uterine tissue. Hysterectomy removes the entire uterus. Endometrial ablation removes the endometrial lining of the uterus, which relieves heavy bleeding. In myolisis, an electrical needle is inserted into the uterus through a small incision in the abdomen to destroy the blood vessels feeding the fibroid. UFE is a treatment that cuts off the blood supply to the uterus and the fibroids so they shrink. It is becoming an alternative to hysterectomy and myomectomy. Which of these treatments is used must be determined in consultation with a physician. The clinical evidence supporting natural treatments for fibroids is scarce. For the most part, natural treatments are preventive or treat the symptoms but do not address the fibroids themselves once they are in place.

There are some reports that eating less red meat and pork reduces fibroids and some women have reported success with becoming vegetarian. Include raw nuts, seeds, fruits and vegetables in the diet as well as foods high in germanium, that is, garlic, shiitake mushrooms and onions that help improve tissue oxygenation. Avoid caffeine, which has been implicated in fibrocystitis. Recommended nutritional supplements include vitamins A, B-complex, C, K and bioflavonoids. Recommended botanical herbs include chaste tree, ginger, cranesbill, shepherd?s purse, ragwort, blue cohosh and false unicorn as well as ginseng, rhubarb, cinnamon and sargassum seaweed in various combinations. These treatments and appropriate combinations must be discussed with a naturopath.

2) Osteopenia, Osteoporosis. Bone constantly reforms throughout our lives. Cells called osteoclasts reabsorb bone material while cells called osteoblasts generate new bone material. As people age, the process of reabsorbing bone material outstrips the process of generating new bone material.

Osteopenia and the more advanced osteoporosis represent an imbalance in reabsorbtion / bone generation in which osteoclasts are more active than osteoblasts, a situation caused by a reduction in estrogen. Estrogen has an important role in the strengthening and calcification of bone. A drop in estrogen at the time of menopause may also be associated with a decreased ability of the body to absorb calcium efficiently. One of the problems in how the news of the Women?s Health Initiative was brought to the public was that the increased risk of breast cancer demonstrated in some segments of the study were highlighted and other aspects of the health risks associated with aging and with menopause obscured. There is a feeling among some specialists that as a result, women are being advised to abandon HRT, at great risk to their future health. There are reports indicating that the greater danger is osteoporotic fracture and consequent disability and confinement to nursing homes at a much younger age than might otherwise be required.

As sales plunge, Barnes & Noble says it will stop making Nook ...

Investors were expecting a bad earnings report from Barnes & Noble on Tuesday morning, and?they definitely got it: Barnes & Noble?s Nook business lost a lot of money, dragging down the entire company?s results. In response, Barnes & Noble said it will stop manufacturing Nook tablets in-house, though it will keep developing its e-ink readers.

The company?s revenues were down 7.4 percent compared to this time last year, to $1.3 billion, in the fourth quarter of fiscal year 2013, with a net loss of $118.6 million, or $2.11 per share. For the full fiscal year, revenues were down 4.1 percent to $6.8 billion, with net losses of $154.8 million, or $2.97 per share, compared to $65.6 million the previous year. Shares were down 10 percent before the market opened.

Nook sales and digital content sales fall, despite slashed prices

Nook HD tablets price cutNook lost a ton of money: Nook revenues were down 34 percent to $108 million for the quarter, compared to $168 million this time last year. For the full year, Nook revenues declined by 16.8 percent to $776 million, compared to $933 million the previous year. ?Device sales declined during the fourth quarter due to lower selling volume,? the company said. ?Digital content sales increased 16.2 percent for the full year, however, they decreased 8.9 percent for the fourth quarter due in part to the device sales shortfall as well as the comparison to the?The Hunger Games?and?Fifty Shades of Grey?trilogies a year ago.?

In an attempt to stanch the bleeding, B&N said it will create ?a partnership model for manufacturing? those tablets, while continuing to develop e-ink readers in-house. ?The company?s tablet line will be co-branded with yet to be announced third party manufacturers of consumer electronics products,? the company said. (Gotta point out that B&N slashing the Nook line was one of my predictions for 2013.)

Barnes & Noble recently?slashed prices on those tablets, and the money it spent doing so contributed to its losses: ?Nook EBITDA losses were $177 million for the fourth quarter, which include an additional $133 million of inventory charges as the company adopted more aggressive promotional strategies given the shift in strategic direction. Nook EBITDA losses were $475 million for the full year, primarily driven by cumulative Nookinventory related charges of $222 million.?

Barnes & Noble says it will keep selling Nook tablets through the holiday season, will keep building its digital content catalog and will keep focusing on e-readers. ?We plan to continue to innovate in the single purpose black-and-white e-reader category,? CEO William Lynch said in a statement, ?and the underpinning of our strategy remains the same today as it has since we first entered the digital market, which is to offer customers any digital book, magazine or newspaper, on any device.?

In an investor call following the earnings report, Lynch said that ?the majority of the content sales come from non-tablets? and that e-readers have ?been our primary customer acquisition vehicle for content.? (Yet Barnes & Noble keeps building out its multimedia content.)

In the call, Lynch didn?t share any more details on how third-party relationships for tablets will work. ?We want to move away from taking on all that risk ourselves,? he said, adding that the ?sub-8-inch? tablet market ?got extremely competitive?and it was very capital-intensive to build our own tablets.? Barnes & Noble is in discussions about manufacturing with ?a lot of parties? and further details will come eventually.

Retail sales: Also not so hot. College does better

If Nook hadn?t done so badly, the poorly performing retail segment ? which consists of both bricks-and-mortar stores and BN.com ? would be getting more attention this morning: Retail revenues fell 10 percent for the quarter, to $948 million, and fell 5.9 percent for the year, to $4.6 billion. Even here, Nook played a role: ?Fourth quarter comparable bookstore sales decreased as a result of lower NOOK unit volume and a stronger title lineup in the prior year.? One bright spot: for the fiscal year, retail EBITDA was up 16 percent to $374 million, ?as the sales decline was mitigated by a higher sales mix of higher margin core products and lower expenses.?

Barnes & Noble founder Leonard Riggio, who is also the company?s largest shareholder,?offered in February?to buy the chain?s retail stores and BN.com and take them private. B&N formed a strategic committee to evaluate that offer but hasn?t released a timeline for answers, and refused to provide any further comment in the investor call.

The college segment ? which Microsoft has a stake in, along with the Nook business ? did better: Revenues were $252 million for the quarter, up 10.7 percent, and $1.8 billion for the year, up 1.1 percent. College EBITDA was up to $3.8 million, but ?full year EBITDA declined 3.9% to $111.5 million, primarily resulting from increased investments in digital education. College?s full-year product margins improved on a higher mix of higher margin textbook rentals, while expenses increased due to new store growth and continued investments in digital education.

Finally, the quarter?brought a TechCrunch report?that Microsoft, which already has a stake in B&N?s Nook and college businesses, is interested in buying those businesses outright for $1 billion. After today?s news about its performance, it?s unlikely Microsoft would want to shell out that much cash, though there are still some compelling reasons for it to buy the Nook digital content business. Barnes & Noble provided no information about this on the investor call.

Two mutations triggered an evolutionary leap 500 million years ago

June 24, 2013 ? Evolution, it seems, sometimes jumps instead of crawls. A research team led by a University of Chicago scientist has discovered two key mutations that sparked a hormonal revolution 500 million years ago.

In a feat of "molecular time travel," the researchers resurrected and analyzed the functions of the ancestors of genes that play key roles in modern human reproduction, development, immunity and cancer. By re-creating the same DNA changes that occurred during those genes' ancient history, the team showed that two mutations set the stage for hormones like estrogen, testosterone and cortisol to take on their crucial present-day roles.

"Changes in just two letters of the genetic code in our deep evolutionary past caused a massive shift in the function of one protein and set in motion the evolution of our present-day hormonal and reproductive systems," said Joe Thornton, PhD, professor of human genetics and ecology & evolution at the University of Chicago, who led the study.

"If those two mutations had not happened, our bodies today would have to use different mechanisms to regulate pregnancy, libido, the response to stress, kidney function, inflammation, and the development of male and female characteristics at puberty," Thornton said.

The findings were published online June 24 in the Proceedings of the National Academy of Sciences.

Understanding how the genetic code of a protein determines its functions would allow biochemists to better design drugs and predict the effects of mutations on disease. Thornton said the discovery shows how evolutionary analysis of proteins' histories can advance this goal, Before the group's work, it was not previously known how the various steroid receptors in modern species distinguish estrogens from other hormones.

The team, which included researchers from the University of Oregon, Emory University and the Scripps Research Institute, studied the evolution of a family of proteins called steroid hormone receptors, which mediate the effects of hormones on reproduction, development and physiology. Without receptor proteins, these hormones cannot affect the body's cells.

Thornton's group traced how the ancestor of the entire receptor family -- which recognized only estrogens -- evolved into descendant proteins capable of recognizing other steroid hormones, such as testosterone, progesterone and the stress hormone cortisol.

To do so, the group used a gene "resurrection" strategy. They first inferred the genetic sequences of ancient receptor proteins, using computational methods to work their way back up the tree of life from a database of hundreds of present-day receptor sequences. They then biochemically synthesized these ancient DNA sequences and used molecular assays to determine the receptors' sensitivity to various hormones.

Thornton's team narrowed down the time range during which the capacity to recognize non-estrogen steroids evolved, to a period about 500 million years ago, before the dawn of vertebrate animals on Earth. They then identified the most important mutations that occurred during that interval by introducing them into the reconstructed ancestral proteins. By measuring how the mutations affected the receptor's structure and function, the team could re-create ancient molecular evolution in the laboratory.

They found that just two changes in the ancient receptor's gene sequence caused a 70,000-fold shift in preference away from estrogens toward other steroid hormones. The researchers also used biophysical techniques to identify the precise atomic-level mechanisms by which the mutations affected the protein's functions. Although only a few atoms in the protein were changed, this radically rewired the network of interactions between the receptor and the hormone, leading to a massive change in function.

"Our findings show that new molecular functions can evolve by sudden large leaps due to a few tiny changes in the genetic code," Thornton said. He pointed out that, along with the two key changes in the receptor, additional mutations, the precise effects of which are not yet known, were necessary for the full effects of hormone signaling on the body to evolve.

'Monsters University' Box Office: Pixar Film Beats Out 'World War Z'

LOS ANGELES ? Turns out zombies and Superman are no match for monsters.

Disney's "Monsters University" is the weekend box-office winner, according to studio estimates released Sunday. The animated family film, which reunites stars Billy Crystal and John Goodman and their characters from the 2001 hit "Monsters, Inc.," debuted in first place with $82 million, beating out swarming zombies in "World War Z" and Superman himself in "Man of Steel."

"The diversity of this weekend is part of what makes this business so great," said Dave Hollis, Disney's head of distribution. "It's a really extraordinary weekend for the industry."

Especially for "Monsters University," Pixar's 14th consecutive film to open in first place. Such expectations of excellence put a "healthy pressure" on filmmakers, Hollis said: "To deliver that kind of quality consistently is a differentiator in the marketplace."

Still, the film exceeded studio expectations with its domestic totals, he said.

Paramount's Brad Pitt zombie romp overcame critical advance publicity to open in second place with $66 million. Media reports months ahead of the film's opening chronicled its problems, including a revamped ending that delayed its release.

Rewrites and reshoots sent the film over budget. It ended up reportedly costing more than $200 million to make, but early reviews were positive.

"What `World War Z' proves is that all the negative backstory that can be thrown at a movie doesn't matter if the movie's good," said Paul Dergarabedian of box-office tracker Hollywood.com. "I don't think the audience cares one lick if they had to reshoot the ending if they like the ending and like the movie."

The success of the film means it could be a franchise in the making. Paramount's president of domestic distribution, Don Harris, called the opening "spectacular."

"It's the biggest live-action original opening since `Avatar,'" he said. "(It's) Brad Pitt's biggest opening ever, and in terms of Paramount's recent history, it ranks behind `Iron Man' and `Transformers' as the third largest potential franchise opening in the history of the company."

Warner Bros. "Man of Steel" was third at the box office, adding another $41.2 million to its coffers and bringing its domestic ticket sales over $210 million in just the second week of release.

The Sony comedy "This Is the End," which stars Seth Rogen, James Franco and Jonah Hill as versions of themselves trapped in a mansion during the apocalypse, finished in fourth place.

Summit Entertainment's magic-heist thriller "Now You See Me" held onto fifth place in its fourth week in theaters.

Estimated ticket sales for Friday through Sunday at U.S. and Canadian theaters, according to Hollywood.com. Where available, latest international numbers are also included. Final domestic figures will be released on Monday.

Andrew W.K. sets drumming record at MTV O Music Awards

LOS ANGELES (Reuters) - Musician Andrew W.K., the self-described "party king," set a new world record after playing drums nonstop for 24 hours during MTV's O Music Awards this week.

The O Music Awards, which give out accolades in a variety of fan-voted categories to musicians who make a significant impact online through social media, was streamed solely online as a 24-hour virtual concert.

The 34-year-old American, who was born Andrew Fetterly Wilkes-Krier, drummed for 24 hours from Wednesday to Thursday, earning the world record for Longest Drum Session in a Retail Store, MTV said in a statement.

A message left seeking confirmation from Guinness World Records, which verifies official records, was not immediately returned.

Artists such as the Jonas Brothers, Hanson, Atlas Genius and Kate Nash performed from the MTV studios in New York, Los Angeles and Nashville during the 24-hour live music festival that MTV billed as the largest online-only event of its kind.

The network said that more than 100 million votes had been cast by fans online.

Winners included Joe Jonas for Best Artist Instagram, rocker Jack White for Analog Genius and German pop group Tokio Hotel for Fan Army FTW (For The Win).

Yoko Ono, 80, wife of late Beatle John Lennon, won the Digital Genius Award for her online art and music work, as well as her digital presence on social media.

Newcomer band Darling Parade was also selected from 50 new artists to play at the MTV Video Music Awards in August.

Now in its third year, the O Music Awards has attempted to set a new record each year.

At the first O Music awards in Las Vegas in 2011, rapper Chiddy of rap duo Chiddy Bang set a Guinness World Record for the "longest freestyle rap" and "longest marathon rap" after performing for more than nine consecutive hours.

In 2012, rockers Flaming Lips set a record for most concerts played in 24 hours, as they performed in eight cities, traveling by bus, breaking rapper Jay Z's previous record for seven cities in 24 hours via private jet.

MTV and its sister channels VH1 and CMT, which also participated in the O Music Awards, are part of Viacom Inc.

Stocks extend slide as China heightens anxiety

NEW YORK (AP) ? For investors, there was no place to go on Thursday.

A day after the Federal Reserve roiled Wall Street when it said it could reduce its aggressive economic stimulus program later this year, financial markets around the world plunged. A slowdown in Chinese manufacturing and reports of a credit squeeze in the world's second-biggest economy heightened worries.

The global sell-off began in Asia and quickly spread to Europe and then the U.S., where the Dow Jones industrial average fell 353 points, wiping out six weeks of gains.

But the damage wasn't just in stocks. Bond prices fell, and the yield on the benchmark 10-year Treasury note rose to 2.42 percent, its highest level since August 2011, although still low by historical standards. Oil and gold also slid.

"People are worried about higher interest rates," said Robert Pavlik, chief market strategist at Banyan Partners. "Higher rates have the ability to cut across all sectors of the economy."

The question now is whether the markets' moves on Thursday were an overreaction or a sign of more volatility to come. What is becoming clearer is that traders and investors are looking for a new equilibrium after a period of ultra-low rates, due to the Fed's bond-buying, which helped spawn one of the great bull markets of all time.

It doesn't mean the stock run-up is over. After all, the S&P 500 is still up 11.4 percent for the year and 135 percent since a recession low in March 2009. But it may suggest the start of a new phase in which the fortunes of the stock market are tied more closely to the fundamentals of the economy.

And that might not be a bad thing. The reason the Fed is pulling back on the bond-buying is because its forecast for the economy is getting brighter.

The job market is improving, corporations are making record profits and the housing market is recovering.

"People are overreacting a little bit," said Gene Goldman, head of research at Cetera Financial Group. "It goes back to the fundamentals, the economy is improving."

The Dow's drop Thursday ? which knocked the average down 2.3 percent to 14,758.32 ? was its biggest since November 2011. It comes just three weeks after the blue-chip index reached an all-time high of 15,409. The index has lost 560 points in the past two days, wiping out its gains from May and June

The Standard & Poor's 500 lost 40.74 points, or 2.5 percent, to 1,588.19. It also reached a record high last month, peaking at 1,669. The Nasdaq composite fell 78.57 points, or 2.3 percent, to 3,364.63.

Small-company stocks fell more than the rest of the market Thursday, a sign that investors are aggressively reducing risk. The Russell 2000 index, which includes such stocks, slumped 25.98 points, or 2.6 percent, to 960.52. The index closed at a record high of 999.99 points Tuesday.

The yield on the 10-year Treasury note rose to 2.42 percent, from 2.35 percent Wednesday. The yield, which rises as the price of the note falls, surged 0.16 percentage point Wednesday after the Fed's comments. As recently as May 3, it was 1.63 percent.

A Fed policy statement and comments from Chairman Ben Bernanke started the selling in stocks and bonds Wednesday.

Bernanke said that the Fed expects to scale back its massive bond-buying program later this year and end it entirely by mid-2014 if the economy continues to improve.

The bank has been buying $85 billion a month in Treasury and mortgage bonds, a program that has made borrowing cheap for consumers and business. It has also helped boost the stock market.

Alec Young, a global equity strategist at S&P Capital IQ, said investors weren't expecting Bernanke to say the program could end so quickly, and are adjusting their portfolios in anticipation of higher U.S. interest rates.

"What we're seeing is a pretty significant sea-change in investor strategy," Young said

For much of the year, the stock market rose with barely an interruption. The S&P 500 climbed for seven months straight from November 2012 through May. Investors, fearful of missing out on the rally, pounced on any dips and pushed markets to record highs. On Thursday, those opportunistic buyers were absent. Nobody wanted to stand in the way of the market's slide.

As investors sold stocks, they likely put the proceeds in cash "for fear the deterioration will continue," said Quincy Krosby, a market strategist at Prudential Financial.

The sharp increase in bond yields prompted investors to sell homebuilders, whose business could be hurt if the pace of home buying slows down. Those stocks fell Thursday even though the National Association of Realtors said U.S. sales of previously occupied homes last month topped 5 million at an annual rate for the first time in 3 ? years.

PulteGroup plunged $1.89, or 9.1 percent, to $18.87. D.R. Horton fell $2.13, also 9.1 percent, to $21.31.

Markets were also unnerved after manufacturing in China slowed at a faster pace this month as demand weakened. That added to concerns about growth in the world's second-largest economy. A monthly purchasing managers index from HSBC fell to a nine-month low of 48.3 in June. Numbers below 50 indicate a contraction.

A big jump in the overnight lending rate in China also unsettled investors, said Brad Reynolds, a financial advisor at LJPR. The rate measures how much banks charge each other to borrow short-term money. The People's Bank of China was forced to pump about 50 billion yuan, about $8 billion, into the Chinese financial system to alleviate the squeeze, Bloomberg News reported.

Before trading began Thursday on Wall Street, Japan's Nikkei index lost 1.7 percent. The FTSE 100 index of leading British shares fell 3 percent while Germany's DAX dropped 3.3 percent.

In currency trading, the dollar rose to 97.34 Japanese yen from 96.54 yen. The euro fell against the dollar, to $1.3197 from $1.3274.

Gold plunged, leading a rout in commodity prices. Gold dropped $87.80, or 6.4 percent, to $1,286.20 an ounce. Silver fell $1.80, or 8.3 percent, to $19.823 an ounce. Both are at their lowest since September 2010.

Traders dumped gold and silver as their appeal as insurance against inflation and a weak dollar faded. Both became less of an issue after the Fed said it was contemplating an end to its bond-buying program.

Oil was swept up in the sell-off. Crude oil had its biggest one-day price drop since November. U.S. benchmark oil for July delivery sank $2.84, or 2.9 percent, to finish at $95.40 a barrel in New York. Gasoline futures fell more than 3 percent.

Some investors said the sell-off in stocks may be overdone. The Fed is considering easing back on its stimulus because the economy is improving. The central bank has upgraded its outlook for unemployment and economic growth.

The S&P 500 is still up 11.3 percent, for the year, not far from its full-year increase of 13.4 percent last year.

Among other stocks making big moves:

? GameStop, a video game store chain that sells new and used games, rose $2.41, or 6.3 percent, to $40.94 after Microsoft backpedaled and said that there will be no limitations on sharing games on its upcoming Xbox One gaming console.

? Rite Aid fell 23 cents, or 7.4 percent, to $2.88 after the nation's third-largest drugstore chain lowered its forecast for 2014 earnings

13-year-old charged with murder after using wrestling move on 5-year-old sister

NEW ORLEANS ? A 13-year-old boy from a New Orleans suburb was charged with second-degree murder in the death of his 5-year-old half-sister after investigators said he told them he repeatedly struck her with wrestling moves imitated from TV.

"The 13-year-old reported he started to wrestle with the victim and practiced 'WWE' style wrestling moves on the 5-year-old," Col. John Fortunato of the Jefferson Parish Sheriff's Office said in a news release Tuesday.

Those moves allegedly included repeatedly slamming the girl on a bed, punching her in the stomach, jumping on her and striking her with his elbow. A coroner's investigation found the girl died of multiple injuries, including broken ribs, lacerations of the liver and internal bleeding.

In a statement released Tuesday, WWE offered condolences to the victim's family but cautioned against attributing the death to its industry.


"Authorities have already charged the accused with second-degree murder and determined that this was not an accidental death due to a wrestling move," the organization said.

?

"As in similar cases, criminal intent to harm and a lack of parental supervision have been the factors resulting in a tragic death."

The boy had been left to babysit the girl by his stepmother when the alleged beating occurred, authorities said. After the beating, the girl later complained of a stomach ache. When she stopped breathing, the boy called 911. Emergency responders could not revive her and she was pronounced dead at a hospital.

The boy was taken to a juvenile facility and booked on a second-degree murder arrest warrant after he was interviewed by homicide Detective Matt Vasquez.

Authorities released the name of the suspect but The Associated Press generally doesn't identify juveniles charged with crimes.

The detective said the boy told him that he knew the wrestling moves on TV were fake, but he was smiling and appeared to enjoy talking about them.

"The 13-year-old continued by saying the victim complained that she was hurting, but he continued to slam, punch and elbow her for an additional two or three minutes, stopping when his mother called him on the phone to check on he and the victim," sheriff's officials said in the news release

Ginobili?s aggressive play drives Spurs to victory over Heat

Manu Ginobili's double-double led the San Antonio Spurs to a 114-104 victory over the Miami Heat in Game 5 of the NBA Finals.

Manu Ginobili had 24 points and 10 assists, and?Danny Green (24 points) hit six 3-pointers ? giving him a Finals series record total of 25 threes ? as the San Antonio Spurs pulled away from the Miami Heat, 114-104, in a critical fifth game of the NBA Finals Sunday night in San Antonio?s AT&T Center.

Ginobili, who was struggling for much of this series, got the starting nod from coach Gregg Popovich ? who decided to go small to start, benching big man Tiago Splitter ? and it paid off big. Tony Parker was also playing an inspired game, hitting for 26 points on 10-14 from the field, with he and Ginobili hitting circus shots from both the perimeter and inside ? in the case of the latter, the Spurs outscored the Heat on drives down the lane, 45-33.

As a whole, the Spurs hit 60% of their field goals, and that was able to sustain them through a number of Heat resurgences in the third and fourth quarters. The Heat, though they were able to close the gap to within one point with three minutes left in the third, never led in the game. The Spurs closed out the period with a 12-1 run that helped them pull away for good.

The Spurs attacked the glass relentlessly, and it brought dividends: 50 points in the paint as opposed to 40 for the Heat. And though they gave up 20 points on 19 turnovers for the game, the fact that all five San Antonio starters scored solidly in double figures ? Tim Duncan had another double-double with 17 points and 12 rebounds, and Kawhi Leonard netted 16 points to go with 8 rebounds and 3 steals ? negated the effects of the turnovers, which have continued to plague the Spurs in the Finals.

And as Leonard was effective in helping keep the Heat?s LeBron James under 20 points per game scoring in previous contests, the Spurs? Boris Diaw gave James fits in this one ? holding him to only 8-of-22 shooting from the field.

The Miami Heat got a strong night from their starting 'Big Three,' with James and Dwyane Wade each scoring 25 points, and Chris Bosh, who had 16. However, they got little help from their back court, with specialists Norris Cole and Mario Chalmers scoring a combined 7 points in 32 minutes of court time. But the bright spot off the bench was Ray Allen, who was 7-of-10 from the floor for 21 points, and also entered the Finals record books with two highly unusual 4-point plays.

The game was intense, with bodies hitting the floor regularly, and lots of contact under the baskets; but it was just the sort of game that San Antonio thrives on at home ? spreading the floor on offense, and taking Miami out of their transition scoring and half-court defense to press into the paint ? along with the occasional drive and kick-out for a three-pointer. For instance, with 4 seconds left in the half, Tony Parker ran right through the Miami defenders to make what was basically an uncontested layup as the buzzer sounded.

Spurs Coach ?Pop? Povovich, in huddle after huddle, set the tone by imploring his team to get physical: that it was a ?big boy? game, and asserting he wanted lots of ?aggression and physicality.? Ginobili and Parker took this to heart, and with Ginobili defying his age with remarkable offensive production (he either scored or assisted on the first six San Antonio possessions), it helped gain the club the necessary momentum in the first quarter (which San Antonio won, 32-19) to carry the Spurs through to the win.

Game 6 is back in Miami on Tuesday night. ?

Nigeria rolls to 6-1 win over Tahiti at Confed Cup

BELO HORIZONTE, Brazil (AP) ? Nigeria rolled to a 6-1 victory at Confederations Cup on Monday over Tahaiti, which was making its debut at a major FIFA tournament.

Nnamdi Oduamadi scored a hat-trick for the African champions, while Elderson Echiejile added two more.

Still, the team from the South Pacific may have had the game's best moment.

Jonathan Tehau headed the ball into the net early in the second half, cutting the deficit to 3-1. The Tahitians then celebrated by pretending to row a boat together.

The goal generated the biggest cheers of the match at the Mineirao Stadium, where the local Brazilians adopted Tahiti as their team while jeering the Nigerians.

Tahiti, is 138th in the FIFA rankings, is used to playing in front of a few hundred players. But thousands were watching in Belo Horizonte and millions more on television.

"We've shown the world there's some real quality in Tahiti," said Marama Vahirua, the only professional on Tahiti's team. "Just our presence here is a victory and it was fantastic to be adopted by the Brazilian public."

Tehau's elation was short-lived, however. Shortly after scoring, he netted an own-goal.

"The last 15 minutes were really difficult for us physically because we've never experienced such a tough game before," Tahiti coach Eddy Etaeta said. "I'd like to pay tribute to my players, they were fantastic."

Here is a list of barbecue inspired flavors that will pair with wines:

  • Smoky ? grilled and smoked meats, as well as vegetables like zucchini, peppers, and onions
  • Sweet ? brown sugar based barbecue sauces, caramelized onions, and desserts
  • Salt ? will enhance tart fruits and citrus notes in wines like chardonnay or chenin blanc
  • Fats? - butter bastes, bacon, cheese, sausages, kielbasas, salmon, and some shellfish
  • Spicy ? roasted poblanos, horseradish, and some high acid vinegars
  • Earthy (umami) ? beef, game, mushrooms, asparagus, and cheese fall into this category
  • Tart/tangy ? mustards, vinegar and citrus bastes, as well as citrus based desserts

If you?re working with steaks on the grill, think about pairing those earthy, smoky notes with a big bold red. A Malbec from Argentina, or a Chilean Cabernet will pair well. Grilling fish, or vegetarian dishes? Try a lighter pinot noir, an unoaked chardonnay, or a South African chenin blanc. Grilled eggplant is also simply delicious with an aged merlot.

Big reds to pair with barbecue meats:

Los Vascos Cabernet Sauvignon 2011 ($11.99) from Colchagua Valley, Chile

From the Bordeaux vineyards of Baron de Rothschild, this winery produces many of the highest rated (and still affordable) wines in Chile. A 100% Cabernet Sauvignon, this ruby red wine has a medium body, and high acid, pairing well with red meats and game. The nose is fruity and fresh, with notes of black pepper, nutmeg, and spice. It is juicy and full-bodied, a very easy to drink summer red wine.

Pair this wine with angus beef burgers topped with Gruyere swiss and portobello mushrooms, or even a bleu cheese and arugula burger with grilled red onions.

Aruma 2011 Malbec ($15.99) from Mendoza, Argentina

This big, dark red wine complements both savory and sweet dishes with its complex palate of red fruits, raspberries, and plums. You?ll notice hints of vanilla, with a smoky, cocoa bouquet, and a round, juicy finish. This wine is highly concentrated, and will pair with everything from a medium rare steak on the grill, to barbecued ribs, and even dessert, like a dark chocolate flourless cake (we love this chocolate olive oil cake from Nigella Lawson). It?s 100% Malbec grapes, and will cellar well for the next 2-3 years.

Cakebread Cellars 2009 Merlot ($54) from Napa Valley, California

This highly acclaimed wine pulls out all the stops, and will impress even the most particular of dinner guests. This aged merlot is full bodied, and deeply complex, with notes of black fruits, vanilla, and black tea. Flavors of cocoa, spice, and tart red fruits are present. A blend of 95% Merlot and 5% Cabernet Sauvignon, the slightly higher alcohol content and high acidity is a perfect match with grilled lamb or tea smoked duck. 90+ points, cellar now through 2015.

Whites to pair with poultry, fish, and vegetarian:

Les Charmes M?con-Lugny Chardonnay 2010 ($14.99) Burgundy, France

Fresh & crisp in the mouth, this white wine has floral and fruity aromas with citrus and aromas reminiscent of muscat grapes. Rich, and full bodied, Le Charmes is an unoaked Chardonnay with great structure and a bit of spice, complementing everything from sausage dishes, to sea bass, and crispy grilled chicken. Well balanced and very drinkable, you?ll want this wine poolside all summer long.

Kopke Douro Vinho Branco 2010 ($15.99) from Douro Valley, Portugal

This? bright, citrusy white from Portugal will shine with anything from scallops and grilled calamari, to asparagus with lemon, and grilled peaches or nectarines with ice cream for dessert.

A blend of Arinto (a high acid grape varietal), Gouveia, and Rabigato, this dry white wine is medium bodied, bright, and perfect for a warm summer evening. Palate shows hints of citrus and peach with a touch of sweetness, and a crisp finish.

Arnaldo Caprai Grecante Grechetto 2011 ($18.99) from Umbria, Italy

High in minerality and made from 100% Grechetto grapes, this wine is one of our favorites for pairing with oysters and salads. A grilled peach and goat cheese salad with shallot rubbed croutons would pair well. Perfect for drinking after dinner on the patio with a simple fruit and cheese plate, this wine is one of our top choices for summer barbecues.

And then there was pink!

Most ros? wines aren?t exactly meant for pairings with smoky, red meats or heavy fare, but unlike their confusing non-counterpart, the ?other pink wine? (aka, white Zinfandel-this is fortified wine, people-read: leftover stuff they sweetened and bottled), ros? wines can be a tart, refreshing, and quite brilliant pairing for hot weather foods. Pair them with fish, chicken, and lots and lots of vegetarian options for a very happy, and entirely impressed, guest list.

Seasonal availability ? l?escargot rose 2012 ($12.99) from C?tes de Gascogne, France

Made from 70% Grenache and 30% Syrah blend, this is a seriously sexy wine. It?s color is pale, and elegant. Profile is structured, dry, and crisp. Flavors of limestone and clay provide great minerality-an indicator for French grown Grenache grapes (the main varietal for this wine). This pale ros? is the result of very delicate handling-from picking to pressing, followed by cool fermentation in stainless steel.

Color is a delicate, pale salmon pink. Nose is citrus with small raspberries and herbs. Soft, seductive, and fresh. A perfect wine for summer and outdoor weddings.

Halter Ranch Rose 2011, ($19, $15.20 for wine club members), Paso Robles, California

On the other end of the color spectrum is this bright, juicy ros? from California. Unlike other California ros? wines that can be rather sweet and cloying, this summer sipper is balance with a blend of Grenache, Mourv?dre, Picpoul Blanc (to add a crisp, zest finish), and Syrah (for depth of flavor). Staying within their typical Rh?ne style, this Grenache-based wine immediately reminds us of wild raspberries or strawberries, melon, as well as guava and tart cherry notes. It?s refreshing, juicy, and finishes dry. A perfect wine to pair with grilled veggies and cheeses, this is our go-to pink for summer!

No matter what your choice of wines this summer, remember that there are no set rules, you can drink what you like, and that like any meal, a summer barbecue is a perfect time to pop open a bottle and try something new with friends.

Dear EarthTalk: The three-year anniversary of the 2010 BP oil spill just passed. What do green groups think of the progress since in restoring the region??Mary Johannson, New York City

When an undersea oil well blew out 50 miles off the Louisiana coast on April 20, 2010 and caused an explosion on the Deepwater Horizon drilling rig above it (killing 11 workers), no one knew that an even bigger disaster was yet to come. Over the next three months, 4.9 million gallons of crude poured into the water before BP could get the wellhead capped to stop the flow of oil into the Gulf of Mexico.

According to BP, which has already spent $14 billion on clean-up and restoration, the Gulf is returning to baseline conditions prior to the disaster. ?No company has done more, faster to respond to an industrial accident than BP did in response to the Deepwater Horizon accident in 2010,? reports the company.

But not everybody sees the situation that way. Many environmentalists are concerned that, while BP has done a thorough job removing visible oil from the water column and surface, little has been done to repair damage to marine life and ecosystems.

?Three years after the initial explosion, the impacts of the disaster continue to unfold,? says Doug Inkley, senior scientist at the National Wildlife Federation (NWF). A recent report by the group found that the three-year-old spill is still having a serious negative effect on wildlife populations in the Gulf. For one, dolphin deaths in the region have remained above average every single month since the disaster. In the first two months of 2013, infant dolphins were found dead at six times pre-spill average rates. Says Inkley: ?These ongoing deaths?particularly in an apex predator like the dolphin?are a strong indication that there is something amiss with the Gulf ecosystem.?

Gulf dolphins aren?t the only ones suffering. NWF found that more than 1,700 sea turtles were stranded in coastal areas of the Gulf between May 2010 and November 2012?almost three times the pre-spill rate for the animals. Researchers have also detected changes in the cellular function of Gulf killifish, a common bait fish at the base of the food chain. And a coral colony seven miles from the offending wellhead struggles due to oil and dispersants compromising its ability to rebuild itself.

?The oil disaster highlighted the gaps in our understanding of the Gulf of Mexico,? says Florida State University oceanographer Ian MacDonald. ?What frustrates me is how little has changed over the past three years. In many cases, funding for critical research has even been even been cut, limiting our understanding of the disaster?s impacts.?

MacDonald and others are optimistic that a federal court will find BP accountable for further damages in a civil trial now underway. NWF says that substantially more money is needed to carry out restoration efforts vital to the biological and economic stability of the Gulf region. ?Despite the public relations blitz by BP, this spill is not over,? says NWF?s David Muth. ?Justice will only be served when BP and its co-defendants pay to restore the wildlife and habitats of the Mississippi River Delta and the Gulf of Mexico.?
